1. Who We Are

bennutrition.com (the "Site") is operated by B.E.N. Bio Energetics Nutrition, Inc., a Wyoming corporation with a place of business at 7345 West Sand Lake Road, ste 210 office 2193, Orlando, FL 32819, United States ("B.E.N.", "we", "us", "our"). You can reach us at contact@bennutrition.com or +1-888-396-3903.

These Terms govern your use of the Site and any purchase you make through it. By using the Site or placing an order, you agree to them. Our Privacy Policy, Shipping Policy, Refund Policy, and Cancellation Policy form part of these Terms.

2. Eligibility

You must be at least 18 years old to purchase from the Site. By placing an order you confirm that you are 18 or older and that the payment method you use is yours or that you are authorized to use it.

3. About Our Products

We sell dietary supplements.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing on the Site is medical advice, and nothing on the Site is a substitute for consulting a qualified health professional. Consult your physician before using our products, and in particular if you are pregnant or nursing, if you have a medical condition, or if you take prescription medication. If you have an adverse reaction, stop using the product and seek medical attention.

Products are intended for personal use in the quantities offered on the Site. We do not authorize resale of our products without a separate written agreement with us.

Product availability, formulations, and labels can change. The label on the product you receive governs.

4. Your Order

Placing an order is an offer to buy. Your order is accepted, and a contract of sale is formed between you and us, when we send you a confirmation that your order has been dispatched. An order confirmation email acknowledging receipt of your order is not acceptance.

We may decline or cancel an order, in whole or in part, where the product is unavailable, where we suspect fraud or a breach of these Terms, where a price or product description was incorrect, or where we are unable to ship lawfully to your destination. If we cancel an order you have already paid for, we refund you in full.

We may limit order quantities.

5. Prices, Duties, and Taxes

Prices are shown on the Site and are stated in U.S. dollars unless indicated otherwise. Prices can change at any time, but a change does not affect an order we have already accepted.

United States orders: applicable state and local sales tax is calculated at checkout.

International orders ship Delivered Duty Paid. Import duties, taxes, and customs fees are calculated and charged at checkout, and nothing further is due on delivery. Full detail is in our Shipping Policy.

Shipments to Brazil are made under the Programa Remessa Conforme of the Brazilian federal revenue service. Brazilian customs requires the recipient's CPF, and you are responsible for providing an accurate one at checkout.

If a price is displayed incorrectly because of an obvious error, we are not obliged to sell at that price. We will tell you and give you the choice of confirming at the correct price or cancelling with a full refund.

6. Payment

Payments are processed by Shopify Payments and by the payment providers offered at checkout. We do not store your full payment card details. You authorize us to charge your payment method for the total shown at checkout, including product, shipping, duties, and taxes.

7. Shipping, Delivery, and Risk

Shipping options, delivery estimates, customs handling, and our treatment of undelivered and refused packages are set out in our Shipping Policy, which forms part of these Terms.

Delivery estimates are estimates, not guarantees. Risk of loss and damage passes to you when you, or someone you have nominated, takes physical possession of the products.

8. Subscriptions and Automatic Renewal

PLEASE READ THIS SECTION BEFORE YOU SUBSCRIBE. IT EXPLAINS THAT A SUBSCRIPTION RENEWS AND CHARGES YOU AUTOMATICALLY UNTIL YOU CANCEL IT.

Some products are offered on a subscription basis. If you choose one:

• Your subscription renews automatically. It continues, and we continue to charge you, until you cancel. There is no fixed end date and no minimum number of deliveries.
• What we charge. On each renewal we charge the payment method you gave us the subscription price then in effect, plus shipping and, outside the United States, import duties and taxes. The amount and the delivery frequency you chose are shown to you before you complete your first order and again in your order confirmation email.
• When we charge. On the recurring date of the billing period you chose.
• Prices can change between deliveries. Product prices, shipping costs, and applicable import duties can all change. We will tell you before a change takes effect on your subscription, and you can cancel before it does.
• How to cancel. At any time, with no fee and no explanation required: from the link in any of your order confirmation emails, by emailing contact@bennutrition.com, or by calling +1-888-396-3903.
• When to cancel to avoid the next charge. Cancel before the next recurring date. Cancelling stops future deliveries; it does not cancel a delivery that has already been charged and dispatched.
• Where subscriptions are available. In every country we ship to, with the exception of Brazil.

By placing a subscription order, you confirm that you have read and accepted these automatic renewal terms.

9. Refunds and Our Guarantee

Our 30-day money-back guarantee, and the conditions that apply to it, are set out in our Refund Policy. That guarantee is a commercial promise we make in addition to the rights the law of your country gives you. It does not replace or reduce them.

10. Consumers in the European Union, the EEA, and the United Kingdom

If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason. This right is separate from, and additional to, our 30-day guarantee, and none of the conditions attached to that guarantee apply to it.

To withdraw, send a clear statement to contact@bennutrition.com, quoting your order number. You must return the goods within 14 days of telling us, and you bear the direct cost of that return. We refund the product price and the standard delivery cost within 14 days of receiving the goods back, or of receiving proof that you have sent them.

As permitted by Article 16(e) of Directive 2011/83/EU and the equivalent provision of the United Kingdom Consumer Contracts Regulations, this right of withdrawal does not apply to a product that was sealed for health protection or hygiene reasons and was unsealed after delivery.

You also keep your statutory rights in respect of goods that are not as described or not of satisfactory quality.

11. Consumers in Brazil

If you are a consumer resident in Brazil, Law No. 8.078/1990 (Código de Defesa do Consumidor) applies to you. Under Article 49 you may cancel your purchase within 7 days of receiving the product, without giving a reason, and receive a full refund of the amounts you paid, including shipping. Send a clear statement to contact@bennutrition.com, quoting your order number.

Nothing in these Terms limits the rights the Código de Defesa do Consumidor gives you.

12. Intellectual Property

The Site and its content, including text, images, video, graphics, logos, and the B.E.N. and B.E.N. Minerals marks, belong to us or to our licensors and are protected by copyright, trademark, and other laws.

You may view the Site and download or print content for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute, modify, or create derivative works from it, or use it for any commercial purpose, without our prior written permission.

13. Acceptable Use

You agree not to use the Site to break the law, to infringe anyone's rights, to introduce malicious code, to attempt to gain unauthorized access to the Site or to any account, to scrape or harvest data by automated means, or to interfere with the operation of the Site.

14. Reviews and Content You Submit

If you submit a review, a photograph, a video, a testimonial, or any other content, you confirm that it is yours to submit, that it is truthful, and that it reflects your honest experience.

You grant us a non-exclusive, worldwide, royalty-free, perpetual, and sublicensable licence to use, reproduce, adapt, publish, and display that content, and the name you submitted with it, in connection with our products and our marketing, in any medium. Sublicensable means that we can extend that permission to the advertising and social platforms we use to run the content.

You can ask us to stop using your content by writing to contact@bennutrition.com, and we will stop using it in new material.

We may decline to publish, or may remove, content that is unlawful, misleading, offensive, or that makes claims about our products that we cannot substantiate.

15. Third-Party Links and Services

The Site may link to sites and services we do not control. We are not responsible for their content, their products, or their privacy practices, and a link is not an endorsement.

16. Electronic Communications and Signatures

When you use the Site or email us, you are communicating with us electronically, and you agree that we may communicate with you the same way. Notices, confirmations, disclosures, and agreements that we send you electronically have the same effect as if they were on paper.

When you click a button such as "Place order", "Subscribe", or "I agree", you are giving an electronic signature and entering into a binding agreement. Under the U.S. Electronic Signatures in Global and National Commerce Act and equivalent laws, that signature has the same effect as a handwritten one.

We send you transactional messages about your orders and your subscription, which are part of the service. Marketing messages are separate: they require your opt-in, and you can unsubscribe at any time.

17. Disclaimers

Except as expressly stated in these Terms and in our Refund Policy, and to the fullest extent permitted by applicable law, the Site and its content are provided "as is" and we make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error free, or that its content is complete, accurate, or current.

Nothing in this section excludes or limits any warranty, guarantee, or right that cannot be excluded or limited under the law that applies to you as a consumer.

18. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, or data, arising out of your use of the Site or your purchase.

To the fullest extent permitted by applicable law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.

Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products where liability cannot be excluded, or for any other liability that cannot be excluded or limited under the law that applies to you as a consumer.

19. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the Site, or your infringement of a third party's rights. This does not apply where the law that protects you as a consumer does not permit it.

20. Suspension and Termination

We may suspend or close your account, and decline further orders from you, if you breach these Terms, if we reasonably suspect fraud, or if you use the Site unlawfully. If we do, we will still honour any order we have already accepted, or refund it in full.

We may also change, suspend, or discontinue the Site, or any product, at any time.

21. Resolving a Problem, Governing Law, and Disputes

Talk to us first. If something goes wrong, email contact@bennutrition.com with your order number and what you would like us to do. Most problems are solved that way. We ask that you give us 30 days to resolve it with you before starting any formal proceeding.

These Terms, and any dispute arising out of them or out of your purchase, are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules, and the state and federal courts located in the State of Wyoming have jurisdiction.

Where applicable law permits a contractual time limit, any claim arising out of these Terms or out of your purchase must be brought within one year of the date on which the claim arose.

Nothing in this section removes any protection given to you by the mandatory consumer law of your country of residence. If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. If you are a consumer resident in Brazil, you keep the rights given to you by the Código de Defesa do Consumidor, including the right to bring proceedings in the court of your own domicile. Where the law of your country sets a limitation period for your claim, that period applies instead of the one-year period above.

22. Changes to These Terms

We may update these Terms. The version in force when you place an order is the version that governs that order. The date at the top shows when these Terms were last updated.

23. General

If a provision of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent.
